In my opinion, Max's behavior is downright sexual harassment, but it's never explicitely depicted as such, which feels kinda inconfortable.
Ms Cross repetedly rejects his advances, but he refuses to acknowledge it.
He manipulates her to try and seduce her, he invents pretexts to get invited to her house during the night, repetedly invokes the memory of her dead husband (who died the year before) and he forcibly tries to kiss her. Basically, a lot of emotional blackmail and manipulation.
